Terms and conditions
These terms and conditions apply to all contracts for the provision of third-party transport services booked through 123 Transfers, whose trading name is 123transfers.com. Based on these contracts 123 Transfers acts as representative for the transportation service provider, therefore the contract is between you and the supplier.
The terms "we" and "our" in these terms and conditions refer to 123 Transfers, "you", "your" to all passengers resulting from the reservation voucher issued on the refinement of the reservation and, if necessary, to those who were to be added or substituted; "supplier" to the transport service provider.
1. 123 Transfers
1.1 123 Transfers is a company registered in Italy, with registered office in Via Pastrengo 1, 21019 Somma Lombarda (Va), Fiscal Code and VAT number: IT03415170129
1.2 These conditions together with other information on the website www.123transfers.com ("the site") and the travel voucher form the agreement between you and us. By making a booking you agree to abide by these conditions. Since at the time of completion of reservation services on the site is a contract between you and the supplier, you must also comply with the terms and conditions of the supplier, detailed beyond.
2. Booking and payment
2.1 You will need to follow the wizard to book a service. All bookings must be made at least 48 hours prior to commencement of service. For reservations up to 24 hours prior to departure, you will need to send an e-mail to email@example.com or call us at (+39) 393.1233.123 and once you have received confirmation make payment according to the instructions that will be provided.
2.2 When two or more persons are included in the same booking, the person who makes the booking guarantees that he had also on behalf of other people and accepts these terms and conditions on behalf of the other parties. You must be at least 18 years of age to make a booking.
2.3 For bookings that are successfully assigned to a supplier will be issued a voucher containing data related to your trip, the data of the supplier and the number of voucher associated univocally to you. It is the responsibility of those making the reservation check before the start of the trip that the data on the booking voucher is correct and, if not, inform 123transfers as soon as possible. 123transfers cannot be held responsible for errors in the execution of the service resulting from incorrect information provided at the time of booking. You must present your voucher to the driver of the vehicle at the beginning of the journey. The supplier can refuse to perform the transfer unless showing the booking voucher.
2.4 We reserve the right, on behalf of the supplier, to refuse orders at our discretion. We do not guarantee to be able to assign a supplier to all reservation requests that we receive. If we are unable to assign your reservation to a supplier, we will send you an email message to inform. In this case we may offer you an alternative solution, which may involve additional expenses will be charged. If you don’t agree with the alternative solution, you will be refund of the sum paid. We confirm your booking request with a booking voucher on behalf of the supplier and by sending it to the e-mail address that you have provided during the ordering process. The data of the supplier will be notified only if your reservation is properly allocated.
2.5 At the time of reservation the total price fixed for the service chosen will be charged. Payment can be made via credit or debit card in accordance with the booking process on this site. We accept Visa and MasterCard credit cards. Once payment is received, 123 Transfers will make your reservation request to the supplier and send by email the reservation voucher in the booking confirmation. The voucher must be presented to the supplier or his representative at the time of commencement of the service. In case of return services, you will be required to present the voucher at the beginning of both trips. In the case of a no-show, the supplier can refuse to perform the service.
2.6 The indicated prices are per vehicle, except for shuttle transfer, for which prices are indicated per person. In particular for private transfers, please note that all children and infants count towards the occupation of the vehicle, regardless of age, and therefore should be included in the total number of passengers at the time of booking. If you need a child seat for a child, we recommend that you bring your own because of the variation in quality and availability in destinations. In some areas you may require local child seats on your behalf. If a child seat is provided by the transport company a fee applies.
2.6 Prices are inclusive of fees and VAT, in accordance with Italian law.
2.8 We reserve the right to modify the prices displayed on our website at any time prior to your reservation.
3. Special requests
If you have any special requests please contact us by e-mail at firstname.lastname@example.org prior to making the reservation. If you make a reservation before having our confirmation of ability to meet your special requests, we will assume no responsibility in case they were not executed.
3.1 Child seats. The EU Directive 2003/20/EC stipulates that children must use an appropriate child seat until they reach 12 years of age or until they reach a height of 135 cm. There is an exemption for licensed taxis, which stipulates that if there is no child seat, children older than three years may travel by wearing a safety belt for adults. Children up to three years may be carried without wearing a seat belt but must travel in the rear of the vehicle.
3.2 Wheelchairs. Suppliers are generally capable of carrying foldable wheelchairs in their vehicles, however we strongly recommend passengers to send a confirmation email to email@example.com before making the reservation and wait for confirmation on this, in order to ensure full satisfaction of your travel needs on the part of the supplier.
4. Changes to your booking
You can make changes directly on the site up to 72 hours before the date of the first (or only) part of the transfer booked at no additional charge or sending an email to firstname.lastname@example.org. If you wish to make changes less than 72 hours before departure, must be sent a change request via email at email@example.com. If your request involves additional costs, they should be paid at the time of the change request.
5. Cancellations by you
Any cancellation of reservations must be made in writing via email at firstname.lastname@example.org. If the cancellation is made when there are more than 48 hours at the beginning of the first book as well as resulting from the booking confirmation voucher, you will be refunded 100% of the amount paid. If cancellation is made less than 48 hours from the beginning of the first book as well as resulting from the booking confirmation voucher, there will be no refund.
6. Changes and cancellation by the supplier
We will inform you as soon as possible in case the supplier decides to make substantial changes to services confirmed, as well as cancellations. We will then endeavor to find alternative services without any additional charge, but there we assume no responsibility.
7. Conditions of carriage
7.1 Behavior. It is your duty to keep respectful behavior of individuals and the safety standards existing in the country of destination. The service supplier and his collaborators, reserves the right to discontinue or not to start the execution of the service if any of the passengers travel on group behavior harassing or likely to jeopardize the safety of passengers or the driver of the vehicle. We and our suppliers do not accept any liability for any costs that you or your travel group exposed as a consequence of the interruption of the transfer for this reason.
7.1.2 It is prohibited to carry on Board of vehicles and consume alcoholic beverages. Smoking is forbidden. We and our suppliers we reserve the right to refuse to carry any person on Board that we can reasonably under the influence of alcohol or drugs.
7.3 Although it is not required, we strongly recommend that during the booking wizard you enter a mobile phone number including country code which will be available during your stay, in order to inform in a timely manner of any changes relating to the services you have booked.
7.4. It is your responsibility to indicate clearly and correctly the destination address at the time of booking. 123 Transfers cannot be held responsible for non-execution of the service caused by incorrect indication of destination at the time of booking.
7.5 You must show the supplier or his collaborator the booking voucher before the beginning of each service. 123 Transfers cannot be held responsible for non-execution of the service caused by the no-show of the booking voucher.
7.6 If your arrival flight is cancelled or diverted to another airport, we recommend you contact us recommended at email@example.com or by phone at + 39. If the new conditions so require, you may be required to pay a supplement. 123 Transfers shall not be liable in this case.
Each passenger is entitled to keep with him during the trip a suitcase or bag of normal size and a small carry-on. You can carry more luggage, but the added baggage may be subject to payment of an additional fee payable at the time of transport.
If you need to carry excess baggage or bulky goods such as skis, bicycles, surfboards, cages for pets, please contact us via email and wait for our confirmation for the carriage thereof. This service may be subject to a supplement, which you will be required to pay at the time of booking. If you book a service without having notified the presence of excess baggage or special, you may be required to pay a surcharge for transport from the supplier before starting the service. In some cases it may be impossible to transport service. 1 2 3 or Services nor the supplier shall be liable for such cases.
We strongly recommend that you label your luggage with your name and destination address. Your luggage is carried at your own risk and 123 Transfers shall not be liable for their loss or damage.
9. Our liability
9.1 We have selected suppliers of transfer services with reasonable care and attention. All suppliers are provided with insurance as provided by the laws in force in the State in which service is carried out. We cannot be held responsible for the provision of transport services unless it is proven that we have not complied with our obligations of diligence and care in selecting the supplier, showing your loss or damage.
9.2 123 Transfers is an intermediary in the supply of transport services, so our responsibility is limited to those of an intermediary between the customer and supplier. Our responsibilities are limited to the publication of information about the services provided by suppliers on our website, to post to the supplier of the information relating to the reservation made by you to send you booking voucher, along with any other information that is necessary for the proper performance of the service and to forward to you any changes applied by the supplier to your booking. The responsibility for the provision of transfer services between the client and the service provider shall be limited to Contracting Parties and therefore any liability shall be borne by the service provider. We do not assume any responsibility regarding information about transfer from us provided in good faith.
1 2 3 9.3 123 Transfers cannot be held liable for any illness, injury, death, loss of luggage or personal effects if caused by its negligence or otherwise arising out of:
a) actions and/or omissions of persons and the persons concerned; or
b) actions and/or omissions of a third party not participating in the provision of the service in a condition that we could not foresee nor avoid; or
c) unusual or unforeseeable circumstances whose cause is outside of our ability to take action and the consequences of which could not have been avoided even with all due care; or
d) an event that we ourselves, our collaborators, employees, agents or suppliers and subcontractors could not foresee or forestall even with all due care.
Any claims relating to diseases, injury, death, loss must be forwarded directly to the service provider and are subject to the laws and jurisdiction of the country in which the service is provided.
9.4 Transfer provided descriptions are derived from information provided to us by the supplier and we assume no liability for inaccuracies, or when changes have been made by the supplier without the latter having informed us about it.
9.5 Our maximum liability to you is limited to twice the total amount paid for your reservation. This limit does not apply in the case of our liability for death or personal injury resulting from negligence on the part of 123 Transfers or its employees in the performance of their duties.
9.6 Our liability is not limited in the case of personal injury or death caused by our negligence or breach of your consumer rights legally recognized.
8 Force majeure
Neither we nor the supplier will also pay you compensation if we or the supplier were to cancel or change a service as a result of unforeseen circumstances outside our control ("force majeure"). Such circumstances may include, but are not limited to, accidents and delays arising, processions and demonstrations have not been foreseen, disturbing events organized, police operations, unforeseen dangerous situations by road traffic, terrorist activity and its consequences or the threat of such activity, riots, acts of Government or other local authorities, strikes, natural or nuclear disasters, fire, severe weather conditions or other similar events beyond the control of the supplier.
9.1 If you have any problems with the service provided, please inform the service provider, or call us at the numbers shown on the booking voucher. We will do our best to determine and solve the problem immediately with the supplier on your behalf. The timely notification of the complaint will allow us to assess the situation correctly and to intervene in a timely manner as provided in these terms and conditions.
9.2 If on your return you would like to send us a complaint or ask to our attention issues relating to services you received, you can send an e-mail to the address firstname.lastname@example.org or contact us at our address, communication Via Tagliata 81, 84010 Positano (SA) Italy. We will understand what happened and give you feedback as soon as possible.
9.3 Any claim must be received in writing within 28 days from the date of service or return transfer in case of round-trip booking.
10.1 We are highly committed to protect and treat your personal and sensitive data, as provided for by applicable legislation. All data related to credit and debit cards will not be in any way displayed by 123 Transfers but only through the intermediary of payment, in accordance with the highest standards of safety and protection.
Our site uses tools to capture your data even if you don't complete the reservation or registration. Such details could be used only for contacting you to ask yourself why you haven't completed your reservation.
11. General conditions
11.1 We may change or update the terms and conditions of this agreement and publish the new version on our website. The conditions governing your booking of any service are those in force and posted on the site at the time of booking.
11.2 In the event that any item, clause, term or condition of this agreement becomes or is declared illegal, invalid or unenforceable for any reason, we will proceed to eliminate such term or provision, without prejudice to the validity of all other terms and conditions.
12. Governing law and jurisdiction
The terms and conditions of this agreement and your use of our website are governed by Italian law. In case of disputes relating to this contract agree to be subject to the exclusive jurisdiction of the Italian courts and agree the jurisdiction on the Court of Milano.
